Slovenian Prime Minister Miro Cerar said on Wednesday that Slovenia would file the lawsuit against Croatia at the Court of Justice of the European Union (CJEU) for its refusal to implement the arbitration ruling decision after the new parliament in Slovenia is formed.

The Prime Minister of the caretaker government had earlier announced that the decision on filing the lawsuit would be made in the Slovenian parliament this Thursday. After consultations with leaders of political parties, the decision was postponed.

Slovenian media reported that Slovenia intended to go through with the planned lawsuit at the CJEU against Croatia even without the support from the European Commission, which decided to remain neutral in the matter and leave the two countries to resolve the issue between themselves.

“There is consensus among the parties that content of the lawsuit needs to be fully prepared, today we discussed the main elements of the lawsuit. There was no opposition, just requests for additional explanations, but the decision was made that party leaders and members of the future parliamentary foreign policy committee would have another discussion on the arbitration lawsuit,” Cerar said after the meeting, which was closed for the public.

Slovenia held its parliamentary election in early June, and the largest party of the election, Janez Jansa’s centre-right Slovenian Democratic Party (SDS) which won 25 seats in the 90-seat parliamentary assembly, will have to form a coalition with at least two other parties in order to have the necessary majority.

Analysts, as well as the election winner, Jansa, are saying that the task will be difficult, and some say that, considering how fragmented the political scene has become, and the ideological and personal conflicts of the leaders of the nine parties which gained seats in the parliament, forming the government will be “impossible.”
