Justice Minister Ivan Malenica said on Tuesday that if the Zagreb County Court rejected former Dinamo football club coach Zoran Mamic's motion to serve his prison sentence in Bosnia and Herzegovina, Croatia might issue an arrest warrant and an extradition request.

Speaking for state television HRT, Malenica said that if the court rejected the motion and if Mamic did not appear before a judge, an arrest warrant would be issued. If Mamić cannot be located in Croatia, an international arrest warrant will be issued, he added

Since Mamic said in his motion that he would not serve his sentence in Croatia, “from that moment he is considered a fugitive and then we can utilize institutes such as extradition.”

If the court grants his motion, the ministry will contact the Bosnia’s Justice Ministry requesting that Mamic serve his prison sentence in Bosnia, and if the ministry grants the request, it is sent to the relevant court which will determine the prison sentence, Malenica said.

In practice, the sentence should be identical to the one delivered in Croatia, but the relevant court applies Bosnia’s criminal law, he added.

Malenica said the Osijek County Court should have ordered precautionary measures for Mamic.

Asked if the court had made a mistake by failing to do so, he said the law gave courts the option to order precautionary measures in case of a flight risk.
