The Supreme Court's general assembly that consists of the court's president and all its judges, concluded that periodic vetting of judges, as proposed in the latest draft amendments to the Courts Act, was unacceptable.

The Supreme Court’s general assembly says that the recurrent vetting of judges “is discriminatory against judges” since such checks are not envisaged for office holders in the executive and legislative branches of authority.

Furthermore, the proposed amendment will make Croatia the only EU member state to conduct such vetting of judges.

Also, the opinion of the Advisory Council of European Judges, a body of the Council of Europe, is that the impact of security services, that are deemed to be a part of the executive authority, on the assessment of the performance of judges and on their careers is in contravention of the principle of separation of powers and the autonomy of the judicial authority, says the Supreme Court’s General Assembly.

The Court is also against the proposal that in the future it will be the justice minister who can appoint court experts, while the opinions of court presidents on those appointments will be non-binding.
