Following Friday's publication of new e-mails related to the Hotmail affair which shows that some suppliers and creditors of the indebted Agrokor food and retail group had received preferred treatment by the state-appointed management, the current emergency management issued a press release.
“The speculations published today about the supposed favoured treatment for certain suppliers by the emergency management, and the alleged conversion of old claims (prior to April 10) into the so-called ‘border debt’ (created prior to April 10 and due to mature after that date) are merely untrue conjectures,” Agrokor said.
“To clarify once again, the so-called ‘border debt’ refers to debt claims which came into existence before the emergency administration took over the company and which was supposed to be paid after April 10, 2017. Under its previous management, Agrokor issued bonds as guarantees of payments to suppliers for goods delivered, and if their maturation happened to be beyond April 10, that was considered ‘border debt’. In addition, every transaction for the delivery of goods and services, and which involved using other financial instruments to extend original maturation date, and which were due to mature after April 10, also constitute Agrokor’s ‘border debt’ towards its suppliers,” Agrokor added.
“These are the facts, and everything else are conjectures that their authors are trying to ‘prove’ using only parts of some e-mails. As the people who had received or sent some of those e-mails are employees of Agrokor, it must be determined whether these have been acquired without permission. If these had been taken without authorisation, legal action will be undertaken, which will, we believe, clear things up,” Agrokor said.
“In addition, the emergency administration has notified the Commercial Court in Zagreb that work on compiling documents showing all payments that have been made to suppliers is under way, and will be published as soon as they are verified. Agrokor does not have a central reporting system, the data of 77 companies included in the emergency administration procedure must be entered by hand, which is the reason why consolidating and verifying this data will require more time. When these documents get released, they will clearly show that conjectures published today are not based on facts,” Agrokor added.
