Hungarian court rejects request for Hernadi's extradition

A Hungarian court has rejected Croatia's request for the extradition of Zsolt Hernadi, CEO of the Hungarian energy company MOL, Hungarian media reported on Thursday.

After the Court of Justice of the European Union (CJEU) in Luxembourg had ruled that Hungary should not have ignored extradition request for Zsolt Hernadi in July this year, the Croatian police requested that Interpol once again extend red notice for Hernadi.

“Police submitted the CJEU ruling to Interpol’s Executive Committee and General Secretariat with a request to once again enter an arrest warrant in Interpol’s data base,” Croatian Interior Ministry said on August 10.

CJEU said in July that Hungary should not have ignored the European arrest warrant based only on the decision by the Hungary’s State Attorney’s Office to suspend the criminal investigation as part of which the wanted person was questioned only as a witness.

“Member states’ legal authorities have a duty to decide on every European arrest warrant sent to them;” the court had said.

Hernadi’s Croatian attorney Laura Valkovic warned after the ruling that CJEU decision did not say that Hungary had to extradite MOL CEO Zsolt Hernadi to Croatia, but that a Hungarian court had to decide on the extradition request.

European arrest warrant on Hernadi was issued after Croatia’s anti-corruption office Uskok accused him of giving former Croatian Prime Minister Ivo Sanader €10 million in bribes so that the Hungarian oil company MOL could acquire management rights in Croatian Ina energy company.
