The Constitutional Court on Wednesday rejected a complaint by the centre-left Social Democratic Party (SDP) candidate for Istria County Prefect, Danijel Feric, about the Electoral Commission's decision, as well as his request to test the constitutionality and legality of the local election after he lost to Istrian Democratic Assembly (IDS) candidate, Boris Miletic, by 40 votes.
The Constitutional Court found that the Electoral Commission’s decision did not violate the Feric’s rights, and rejected the complaint as unfounded, the court said in a press release.
According to the Court, Feric failed to substantiate his claim about the violation of the election procedure in his complaint, nor did he give valid reasons for testing the constitutionality and legality of the election in this case.
The court added that it can conduct the said procedure if it receives a complaint that contains “concrete facts and meets the criteria for the procedure to be implemented.”
The electoral commission confirmed on Saturday that Boris Miletic of the IDS was elected as County Prefect and Tulio Demetlika as his deputy and that the election would not be repeated.
Feric, who said he considers himself the moral victor, said earlier that “the commission’s decision indicated that the election for Istria County Prefect was contaminated,” and that irregularities had occurred at polling stations in areas where IDS was in power.
